Islamic divorce in Jordan

There are two basic scenarios for Islamic divorce before the Shariaa Jordanian courts.


 1: First Scenario: Filing divorce case ( Khulu).

2: Second scenario: FILING DIVORCE CASE in Jordan (Based on fights between the spouse).

First scenario: Filing divorce case " Khulu" in Jordan.

In this way, the wife can file a divorce case in Jordan before the Jordanian Shariaa court based that she does not want to continue her marriage life only with no need to submit any proof, and as a result, you will waive your rights which is agreed in the marriage certificate and also return what you received in the marriage contract, in other words, the wife shall return the amount which is written as received by her in the marriage written contract.


Estimated time:

The estimated time to finalize the divorce and get a divorce certificate using this option will be 4 – 6 months.)

In this case and normal cases, you are not requested to come to Jordan to attend any court session. Also, you do not need any witnesses or proof.

 

Requested documents and evidence:


  • The marriage contract.

  • A Power of attorney from you. Such POA shall be legalized up to the Jordanian embassy in your country.

2: Second scenario: FILING DIVORCE CASE in Jordan based on fights between the spouse:

The husband or the wife can file a divorce case in Jordan before the Jordanian Shariaa court based on claiming that there are fights and disputes between each other, as a result, the court will evaluate the compensation which shall be paid to the wife according to the marriage contract.


Estimated time:


The estimated time to finalize the divorce and get a divorce certificate using this option will be 6 – 12 months.)


Requested documents and evidence:


  • The marriage contract.

  • A Power of attorney. Such POA shall be legalized up to the Jordanian embassy in your country.

  • The wife or the husband will need to provide us with the names of 2 witnesses ( at least) from his/her side to prove the fights between them.
