General provisions regarding inheritance in Jordan:


The Personal Status Law in Jordan regulates inheritance provisions, and I refer to some legal texts on this subject as follows:


It is understood that entitlement to inheritance does not take place until after the deceased has died, and this is clear from the text of Article 280 of the Jordanian Personal Status Law.


Article (280): In order to be eligible for an inheritance, the deceased must be dead, whether actual or legal, and the heir must be alive at the time of the deceased’s death.

What are the cases in which a person is deprived of inheritance in Jordan?


According to Article (281) of the Personal Status Law in Jordan, a person is deprived of inheritance in the following cases:

A - He is deprived of inheritance if he kills his inheritor intentionally, aggressively, whether he was the original perpetrator, accomplice, or causative, provided that the killer, when he committed the act, was of sound mind and adult.

B- There is no inheritance with a difference in religion, so a non-Muslim does not inherit from a Muslim.

C- The apostate Muslim inherits.

Article (282): If two or more people die and there is inheritance between them and it is not known which of them died first, then none of them is entitled to the other’s estate.


What is the fate of the deceased’s money if there is no heir to the deceased in Jordan?


According to the text of Article (284) of the Personal Status Law in Jordan: If there is no heir for the dead person, his movable and immovable estate shall be returned to the Ministry of Endowments, Affairs and Islamic Sanctities.
